What is Mediation?

Mediation focuses on understanding the positions of both sides, discovering information and inventing solutions. A mediation is conducted in a spirit of cooperation and collaboration, rather than in fierce competition.

Why Mediate?

Trials are about finding fault. They essentially determine who is right and who is wrong. On the other hand, a mediation focuses on understanding the positions of both sides, discovering information and inventing solutions. A mediation is conducted in a spirit of cooperation and collaboration, rather than in fierce competition.

Evaluative and Facilitative Mediation

Mediation is a negotiation to achieve case settlement, and while there are different styles and approaches, there is no specific right or wrong style, leaving room for individual mediator preferences, approaches and methods.

My Mediation Approach

Some mediators prefer one approach exclusively, while others use a variety of styles or an amalgam of both styles, depending on the actual case. I think that a mediator should use the best approach for the particular case.

Preparing for Mediation

Whatever the major stage of litigation that is upcoming, be that trial, discovery, or mediation, there is one common element: preparation.
